Please read these General Terms of Use (hereinafter „Terms“) carefully before using the SmartHeat4U app (hereinafter „App“). The SmartHeat4U app is provided by Thermotec AG (hereinafter „Provider“ or „we/us“). By installing and using the app, you agree to the following terms.

Acceptance of the terms

By using the SmartHeat4U app, you fully agree to these terms. If you do not agree with these terms, you may not use the app. We reserve the right to change, update, or add to these terms at any time in our sole discretion. It is your responsibility to check regularly for updates to these terms. Your continued use of the app after changes are posted constitutes acceptance of those changes.

Registration and account creation

To use the SmartHeat4U app, you must register and create a free account. You are responsible for the security and confidentiality of your account and password. You may not share your account with third parties or use it jointly. All activities carried out through your account are your responsibility.

Data protection

Using the app requires entering personal data (name, first name, e-mail address). This data is stored exclusively and in encrypted form on the provider’s server. All transmissions also take place via a secured SSL connection.

Use rights and restrictions

(a) License: The Provider grants you a limited, non-exclusive, non-transferable license to use the SmartHeat4U App on your mobile devices that you own or control, in accordance with these terms.

(b) Restrictions: You agree not to decompile, modify, transmit, sell, license, or create derivative works from the SmartHeat4U app. You may not use the app in an unlawful manner or violate these terms.

The nature and scope of the app

With the app „SmartHeat4U“ (hereinafter „App“), Thermotec AG provides the user with a solution for controlling the AeroFlow electric heaters with the integrated FlexiSmart Pro thermostat.

Free of fees

Thermotec AG provides the user with the app free of charge.

Disclaimer

The SmartHeat4U app is provided „as is“ and „as available“. The provider assumes no liability for the suitability, reliability, or availability of the app for your individual requirements. The provider is not liable for damages or losses arising from the use of the app or from erroneous or delayed transmission of information via the app.

Changes to the app

The provider reserves the right to change, expand, restrict or discontinue the functionality of the SmartHeat4U app at any time. The provider will strive to offer the services and solutions offered as continuously available as possible. The user acknowledges that, despite all efforts, Thermotec AG cannot guarantee a continuously available service. In particular, Thermotec AG reserves the right to restrict or temporarily suspend its services for maintenance, security or capacity reasons at its discretion. Thermotec AG assumes no liability for interruptions or other disruptions.

Resignation

You can terminate the use of the SmartHeat4U app at any time by uninstalling the app from your mobile devices. The provider reserves the right to block or terminate your access to the app for important reasons and at its sole discretion.

Other

Thermotec AG reserves the right to change these terms and conditions at any time without giving reasons, unless this is unreasonable for the user. Thermotec AG will notify the user in good time about changes to the terms and conditions. If the user does not object to the new terms and conditions within six (6) weeks of the notification, the changed terms and conditions shall be deemed accepted by the user. Thermotec AG will inform the user in the notification about their right of objection and the significance of the objection period.

Unless otherwise agreed, the user may submit all explanations to Thermotec AG by e-mail or letter. Thermotec AG may submit explanations to the user by e-mail or letter to the addresses specified by the user as their current contact details in their account. Should any provisions of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.

The place of performance and jurisdiction is the registered office of Thermotec AG. German law applies.
